GENERAL RENTAL TERMS AND CONDITIONS
The “Equipment Rental” service is provided by Happy Trails Portugal Lda, headquartered at Avenida Visconde Tojal, nº 276, Cabanas, 2950-602 Quinta do Anjo, with VAT number 517002108, registered with Turismo de Portugal under no. 468/2022, as a provider of various tourist entertainment services. These rental conditions form an integral part of the rental agreement. By accepting the general terms, the customer confirms that they have read and fully accepted the rental conditions.
Insurance

All Happy Trails Portugal customers are automatically covered by our Public Liability Insurance.
Unexpected Interruption

In the event of illness, accident or any other force majeure circumstance leading to the interruption of tours, Happy Trails Portugal will ensure coverage of costs that are demonstrably included within the clauses of the Personal Accident and Public Liability insurance policies in force. Any other costs, expenses or damages not covered by these policies cannot be attributed to Happy Trails Portugal.
Helmet Use

Certified quality helmets (CE approved) will be provided and, for hygiene reasons, a sterile disposable cap will be supplied to each customer. Helmet use is mandatory whenever riding bicycles and will be kept in perfect condition, cleaned and disinfected after each tour.
Weather Conditions

Happy Trails Portugal customers must be aware that this is an outdoor activity and, as such, is dependent on weather conditions. If adverse changes occur at the start of the tour (for example, at the departure point), customers may:
a) Choose to proceed with the planned tour on wet surfaces, acknowledging the associated risks;
b) Choose to reschedule the tour to a later date agreed between Happy Trails Portugal and the customer;
c) Choose to accept a refund, less a 25% cancellation fee.
Once the customer has agreed to start the tour, Happy Trails Portugal shall have no financial obligation should weather conditions significantly worsen or improve.
Bicycles

All bicycles provided by Happy Trails Portugal meet international standards of quality and safety and comply with manufacturer guidelines regarding servicing, repairs and maintenance.
All bicycles are checked and tested in advance. Participants agree to use them as provided and to immediately notify Happy Trails Portugal if any fault or defect is detected.
Damage and Theft

During Happy Trails Portugal tours, customers are responsible for the use of the equipment, as well as for any damage not resulting from normal wear and tear. They will also be held responsible in cases of theft if adequate precautions were not taken or if no attempt was made to prevent it.
Happy Trails Portugal, acting in good faith, entrusts its equipment to its customers. It is their responsibility to return it in the same condition in which it was received.
GPS

Bicycle tracking system
1- In order to recover the rented vehicle in case of theft or accident, or to locate the customer in case of damage, a GPS tracking device may be installed on the bicycle;
2- The customer expressly agrees to the installation of this safety and monitoring device during the rental period;
3- Happy Trails Portugal guarantees that the collected data will not be personalised, meaning it will only be linked to the vehicle and used strictly for the safety of the customer and rented equipment, with all data being immediately deleted at the end of the contract.
Minimum Age of Customer

The customer must be of legal age to rent a bicycle. Minors may only participate if accompanied by a responsible adult.
Happy Trails Portugal does not define a minimum age for the use of its bicycles or children’s accessories. The choice should be based on the child’s ability, safety and confidence when riding a bicycle. We provide children’s bicycles, trailers and other equipment to adapt the experience to each family’s needs.
The responsible adult assumes full responsibility for the use of the bicycles and for transporting children using any additional equipment (such as trailers, BEE seats, among others). Safety and proper use of the equipment must be ensured by the adult throughout the rental period.
Cancellation Policy

The cancellation policy is as follows:

For cancellations more than 96 hours before the start of the booking: 100% refund.

For cancellations between 48 and 96 hours before the start of the booking: 50% refund.

For cancellations less than 48 hours before the start of the booking: 0% refund.
The Guide

The guide provides preventive information and guidance regarding behaviour and procedures to follow, particularly in terms of safety, route and physical and mental well-being. In the interest of all, customers must comply with and follow the guide’s instructions during the tour.
Failure to comply with these instructions or behavioural irregularities that may put other participants at risk may result in the interruption and termination of the tour without any right to a refund.
Processing of Personal Data

The customer authorises the collection and processing of their personal data within the scope of the execution of the contract with Happy Trails Portugal, Lda. The provision of such data is essential for entering into the contract (failure to provide personal data will prevent the contract from being concluded). Happy Trails Portugal, Lda will process data in strict compliance with applicable data protection legislation (namely Regulation (EU) No. 679/2016 of 27 April – General Data Protection Regulation / “GDPR”), implementing appropriate technical and organisational measures to ensure the confidentiality, integrity and availability of personal data, under the following conditions:

Data Recipients: Happy Trails Portugal, Lda. Personal data may also be shared, where appropriate and in accordance with applicable law, with entities to whom the data must be disclosed by legal obligation and with third-party service providers acting on behalf of Happy Trails Portugal, Lda (subcontractors), under a written agreement ensuring compliance with GDPR requirements.

Data Retention: Personal data will be retained only for the period necessary for the purposes for which it was collected or, if longer, for the period required by applicable law.

Data Subject Rights: As a data subject, you may exercise your rights of access, rectification, restriction, objection and erasure of your personal data at any time, subject to legal limitations, by submitting a written request via email to the Data Controller or by post to the company’s registered address. If your rights are violated, you may lodge a complaint with the National Data Protection Authority.

NATURE TOURISM – Environmental Best Practices
Declaration of adherence to the code of conduct established by Ordinance no. 651/2009, of 12 June

Noise and disturbance to wildlife, particularly in shelter and breeding areas, must be avoided;

Wildlife observation should be carried out at a distance and preferably using binoculars or other suitable optical equipment;

Food must not be left in the field nor provided to wild animals;
-
Animals, plants, fungi or geological samples must not be collected;
-
Injured wild animals should, whenever possible, be collected and delivered to ICNF, I.P., or to the Nature and Environmental Protection Service of the National Republican Guard (SEPNA), or otherwise reported to these entities for appropriate handling;

Environmental accidents or violations must be promptly reported to the competent authorities;
-
Waste and litter produced must be collected and disposed of in appropriate locations;

Fires may only be lit in authorised areas;
-
Regardless of the nature of the activity, all movements must use existing paths and trails;

Signage must be respected.
