Rent-a-bike terms and conditions

General information

When accessing the website happytrailsportugal.com (the “Website”), the User must be aware of the following provisions applicable to each of the documents, information, data and requirements found therein and which is owned and maintained by Happy Trails Portugal Unipessoal Lda, a limited liability company with registered office at Rua Veiga Leitão Nº 3, registered at the Setubal Commercial Registry under the single registration and legal person number 517002108, with a share capital of 3,000.00 Euros, from now on abbreviated as “Happy Trails Portugal”.

By customer, we mean the user of the bicycle, the individual on whose behalf the contract for the use of the bicycle will appear. Only customers are authorized to use the bicycle and benefit from the service conditions. In the execution of this contract, the customer expressly and unreservedly acknowledges that he is solely responsible for the company Happy Trails Portugal, and will also be solely responsible for all amounts to be charged under the contract, as well as for compliance with the conditions of accession and termination of the contract.

 

1 – Privacy conditions

The purpose of this contract is to define the conditions and civil responsibilities of customers who sign with Happy Trails Portugal Unipessoal Lda., Legal person nº 517002108, hereinafter referred to as Happy Trails Portugal, with registered office at Rua Veiga Leitão Nº3, 2815-895 Almada contracts temporary workers with a fixed term for renting and using bicycles.

This contract is valid and will take effect upon its signature by both parties. Its duration is valid only for the time of renting the bicycle.

The cancellation of any reservation up to 48 hours before the start of the rental is free of charge. All bookings canceled less than 48 hours before the start of the rental will result in the loss in favor of Happy Trails Portugal of the amount already paid as a reservation.

When the customer returns the bicycle before the end of the foreseen rental period, the foreseen but unused time will not be deducted from the rental price.

Except in the case of breakdown not attributable to the customer, accident, theft, theft, fire or other cause of a major nature, when 1 hour has passed after the scheduled time for returning the bicycle, a penalty of €2 must be paid. (two euros, VAT included at the legal rate in force) for every 1 hour of delay, a penalty that will be billed to the customer later. 24 hours after the rented bicycle has not been returned, a criminal complaint will be filed against the customer for theft.

The rental costs will be paid in cash when the contract is signed.

For the convenience of the Customer, Happy Trails Portugal offers the following means of payment for products and/or services:

ATM;

MBWay;

Paypal;

In case of deterioration, loss, theft, theft or damage to the bicycle, the customer must notify Happy Trails Portugal immediately. The customer will be responsible for any damage caused to the rented material, and must indemnify Happy Trails Portugal in the amount that becomes necessary for its full recovery. All other Happy Trails Portugal interventions will be billed to the customer per incident (for example: intervention or travel by the entity when a bicycle is not delivered at the place of origin, forgetfulness or loss.)

Deterioration, loss, theft and/or theft is not a reason for suspension and/or termination of the contract on the customer’s initiative, the rental continuing to be billed in accordance with the conditions initially contracted.

The renting of a bicycle to the customer includes, from the outset, coverage by a personal accident policy from the company Allianz Nº 206532022

In the event of an accident against third parties, the customer is responsible for paying €250.

The customer declares to accept that in certain circumstances, namely, in case of simultaneous request from several customers that exceeds the number of bicycles available at the time in question, Happy Trails Portugal, may not be able to provide bicycles, which is why its commitment limited.

2 – General Conditions

Happy Trails Portugal undertakes to provide the customer with temporary use and for predetermined periods by reserving the bicycles that make up its fleet and which is affected by the pursuit of the purposes of this contract, under the terms of these General Conditions and the Private conditions. The delivery and collection of the bicycle(s) and accessory(s) is carried out at the premises of Happy Trails Portugal. The delivery and collection of the bicycle(s) and accessory(s) may also be carried out in a place previously agreed by the parties, and the cost of such delivery and collection is made as follows:

Prices for a unit with delivery and collection service included for 3 days (contracted minimum – 2 bicycles):

  • 99€ Electric Fat Bike
  • From 4 days or more, delivery and collection is included in the rental price and there is no extra charge to be paid.
a) Acceptance of the rental company.

In order to benefit from the services related to the bicycle rental and to obtain the acceptance of Happy Trails Portugal, the customer must show the originals of the following documents:

– Valid identification document (such as Citizen Card, Identity Card, Passport, …);

– Certificate from the Commercial Registry Office, in the case of a legal person.

Registration by minors must be carried out by those who legally represent them. Happy Trails Portugal reserves the right to verify the accuracy of the documents delivered and to reject the acceptance of the proposal to anyone who, for example, shows visible signs of drunkenness, is under the influence of drugs, as well as if the individual suffers from any disorder of a psychological nature or physical disability that prevents the safe and correct use of the equipment.

Whenever any of the personal elements undergo changes, the customer undertakes to inform Happy Trails Portugal under penalty of termination with just cause of this contract.

When booking the bicycle(s) and/or accessory(s), the customer will be charged 30% of the rental price if the reservation is made through the website www.happytrailsportugal.com or the entire rental price if the reservation must be made at Happy Trails Portugal facilities, and the reservation must be made, in any case, 24 hours in advance.

The customer must also deliver, when signing the contract, €200 which will be returned upon delivery/collection of the bicycle and/or accessories provided that they are in the same conditions in which they were collected/delivered.

b) Bicycle

The rental contract applies to bicycles and/or accessories as defined in the particular conditions of the contract, which the customer acknowledges having full knowledge of. As far as possible, Happy Trails Portugal will endeavor to make available to the customer a bicycle corresponding to the preferences expressed by him. However, it may always happen that Happy Trails Portugal has to make a bicycle available to the customer according to the availability of bicycles at the time of booking.

The bicycle is delivered in good working order with the structure in good condition, subject however to defects that are not visible and/or apparent. The vehicle’s two tires will meet the legal requirements that allow circulation. In the event of deterioration of one or more tires for reasons other than the normal wear and tear inherent in their circulation, they will be replaced by Happy Trails Portugal, with the respective cost borne by the customer. In case of disappearance of the bicycle and/or accessories, its replacement will be borne by the customer through compensation to be paid to Happy Trails Portugal according to the price list contained in the particular conditions.

The customer undertakes to use the bicycle driving in accordance with the terms of the legislation in force and in accordance with the Highway Code, not being able to use it outside the territorial space of mainland Portugal.

Travel assistance (going to the site, labor) is free within a 10 km radius of the Happy Trails Portugal facilities. Within a radius of more than 10 km and less than 30 km from the Happy Trails Portugal facilities, travel assistance will cost the customer €1 per km travelled. Within a radius of more than 30 km from the facilities of Happy Trails Portugal, the customer must, in the event of a breakdown, immediately contact Happy Trails Portugal so that it can take steps to find a repair point as close as possible to the customer, and this move to the same by its own means and cost. The roadside assistance only works between 9 am and 6 pm, from Monday to Saturday.

The loan or any other form of transfer of use of the bicycle to any person not expressly authorized by the contract and/or by Happy Trails Portugal    is not allowed. In any case, the customer will remain responsible, in his capacity as a contractor, for the amounts owed and/or to be invoiced in connection with the execution and/or termination of this contract.

c) rental

The rental contract must indicate the day, time and place of collection/delivery of the bicycle, as well as the duration of the rental.

a) Bike pick up and drop off

After picking up/delivering the bicycle, it remains in the custody of the customer, who is entirely responsible for it and its accessories until the moment of its return at the same place where it was collected or until the moment of collection at a place previously agreed with Happy Trails Portugal.

If the customer finds, when picking up and/or returning the bike, that it is not in working order, he must immediately notify Happy Trails Portugal

b) Increased rental period (requested when using the bike)

If the customer wishes to extend the duration of their rental, they should contact Happy Trails Portugal   requesting a change to it and waiting for the respective authorization.

c) Delay in return

The customer must inform Happy Trails Portugal of any and all delays that could affect the return within the terms established in the contract. This same period of delay will be due by the customer according to the contractual tariff, plus a penalty as provided for in the particular conditions of the contract. In the event that the delay is equal to or greater than twenty-four hours, and does not result from an express agreement between the parties, Happy Trails Portugal reserves the right to file a theft complaint against the customer.

d) Breakdowns, accidents, incidents, degradations, thefts or accidents

In any of the cases mentioned above, occurring during the rental period, the customer must contact Happy Trails Portugal. The costs of towing and repairing the bicycle on site, such as replacing parts or tyres, will be borne by Happy Trails Portugal as long as it results from wear and tear or any other normal circumstance inherent in the correct use of the bicycle. Any repairs must be carried out at Abílio Bikes facilities or in a place indicated by the latter. In case of theft during the rental period, the customer is fully responsible for paying for the bike and its accessories and components. The amounts to be paid are present in the contract that the customer signs when renting the bike.

a) Invoicing

The customer owes the following amounts to the company: Happy Trails Portugal

– registration fees, which are non-refundable and allow the customer to benefit from the rental company’s services;

– rental rates, other expenses (fines, penalties and/or compensation corresponding to delays, thefts or robberies…), management expenses, fines and miscellaneous expenses;

– reimbursement of repair expenses.

The rental rates will be those in force on the date of signature of the contract, in accordance with the modalities defined in the specific conditions of the contract, and will be applicable on the date of signature of the same.

The contract details will be the same as those on the invoice. The invoice is issued after signing the contract and is subject to immediate payment.

b) Responsibility for storing the bicycle

Any and all damage, accident, theft or degradation of the bicycle and its accessories will be the responsibility of the customer from the moment he received/picked it up until the moment of its return/collection. In addition to the total responsibility of the customer, all fines for violation of the Highway Code and other legislation. In the event of an accident, the customer undertakes to request a report from the public authority (PSP or GNR) and deliver a copy to Happy Trails Portugal within a maximum period of twenty-four hours. In the event of robbery/theft, the customer must immediately inform the public authority and contact Happy Trails Portugal, except in cases of force majeure, accompanied by a document proving that the formal complaint has been made to the competent authorities.

It is expressly accepted by the customer that Happy Trails Portugal has the right to communicate the identity of the customer to the competent authorities, if he has not done so, if there is suspicion that he has committed an infringement.

c) End of contract

The end of the contract occurs automatically when the bicycle(s) and/or accessory(s) rented by the customer to Happy Trails Portugal is returned or when collected by the latter, and the inherent debts are settled to that same rental contract, if any.

d) Processing of personal data

All personal data collected by Happy Trails Portugal is provided on a voluntary basis and will not be transmitted to third parties, unless authorized by the customer for this purpose, or in cases expressly referred to in the contract.
